Facilitating Cross Border Successions
19th March 2012On 13th March MEPs adopted a regulation, 589 votes in support, 21 against and 79 abstentions, that aims to facilitate 450,000 cross-border sucessions which represent 10% of all successions. This text plans that authorities in the last country of residence have the competence to manage the succession, except if the people involved have indicated that they prefer that their country of origin applies its own legislation. A facultative European Certificate of Succession, should enable heirs, creditors and authorities to process successions rapidly. The text, which will not apply either in the UK, Ireland or Denmark, still has to be adopted formally by the Council, with which an agreement has already been found.
